A wedding photographer in New Jersey recently discovered that a local venue used their original work to generate an AI-based advertisement without permission. The incident highlights growing concerns over the use of intellectual property in the creation of synthetic media.

What happened

In May, a photographer captured the first wedding held at a small local venue. The following February, the venue contacted the photographer via email to request permission to use the photos for a printed brochure. The photographer replied to inquire further about the usage and presentation of the images but did not receive a response from the venue.

Months later, the photographer encountered an Instagram advertisement for the venue that featured a scene clearly generated by AI. Upon questioning the venue through the advertisement, the business confirmed that the image was indeed AI-generated. The photographer identified that the synthetic image was based on their original work because it contained an exact replica of a unique arbor brought to the event by the bride, which appeared in the photographer's original shots. Despite the photographer's desire to maintain a professional relationship with the local business, they expressed concern regarding the unauthorized use of their work for advertising purposes and sought legal guidance regarding potential copyright claims.
