The Delhi High Court has issued an interim order directing the removal of six social media URLs containing AI-generated videos and images that depicted Chief Minister Rekha Gupta as a liquor vendor. The court ruled that while political satire is permissible, the content in question crossed the boundaries of healthy criticism by attacking the individual's dignity.
What happened
Chief Minister Rekha Gupta filed a defamation suit against the Aam Aadmi Party (AAP) and other defendants, seeking a permanent injunction against the circulation of AI-generated deepfake material. The plaintiff alleged that the content, which was published through official and verified social media accounts, portrayed her as a liquor vendor, hawker, and delivery agent. The material also associated her with a fictitious scheme titled 'Har Har Rekha or Ghar Ghar Theka' and included a video involving the Deputy Chief Minister.
Justice Manoj Jain, presiding over the case, acknowledged that political leaders must tolerate criticism in a democratic society. However, the court emphasized that freedom of speech does not grant a license to reduce an individual to an object of ridicule or to inflict irreparable harm on their dignity. The court observed that the use of AI to create these offensive portrayals went beyond the realm of permissible political satire. Finding a prima facie case in favor of the plaintiff, the court ordered the immediate takedown of the six identified URLs and issued summons to the defendants. The matter is scheduled for further consideration on December 4, 2026.
