What happened

The conflict originated from the unauthorized use of Seedance 2.0, which allowed users to generate deepfake-style content featuring high-profile actors. The MPA accused ByteDance of disregarding copyright laws on a massive scale, arguing that such actions threatened the rights of creators and American jobs. The situation drew comparisons to the controversy surrounding OpenAI’s Sora, which faced similar backlash for generating unauthorized content before being shut down earlier in 2026.

Following the cease-and-desist letter, the MPA and ByteDance engaged in several months of negotiations. These talks resulted in an agreement covering ByteDance’s TikTok USDS Joint Venture, CapCut, and the Dreamina platform. Both parties stated that this framework is reflected in the more recent releases of Seedance 2.5 and Seedream 5.0 Pro. While ByteDance’s general counsel, John Rogovin, framed the deal as a foundation for continued cooperation and respect for intellectual property, the specifics of the implemented guardrails and enforcement mechanisms remain undisclosed. Furthermore, the agreement focuses primarily on generated outputs, leaving the issue of the training data used for the underlying models unresolved.
