In July 2026, xAI initiated legal action against Terry Wayne Harwood, a South Carolina resident accused of using the company's Grok AI chatbot to create and disseminate child sexual abuse material (CSAM). This lawsuit follows Harwood’s earlier arrest in February, where he was charged with eight felonies related to the possession and distribution of such material.
What happened
xAI alleges that Harwood intentionally bypassed the company's safety protocols to manipulate non-consensual images. According to the complaint, Harwood used Grok to transform non-sexual photographs into sexually explicit content, with the company claiming that at least some of the images involved in his criminal charges were generated or altered using their tool.
The lawsuit asserts that Harwood breached company policies and exposed xAI to significant legal risk and reputational damage. Following the introduction of image-editing features and a "spicy" mode for Grok, the platform faced criticism regarding the proliferation of sexualized AI deepfakes. This case marks the first instance of xAI suing a user over the creation of deepfakes using its technology. The company is seeking financial damages to cover expenses incurred from legal actions filed by victims, as well as a permanent injunction to prevent Harwood from accessing or using Grok in the future.
