On July 29, 2026, Madison County authorities announced the first arrest in the state involving fully artificial intelligence-generated child pornography. Kenneth Todd Arrington, 59, was arrested and charged with two counts of production of pornography involving minors following an investigation by the Huntsville Police Department’s Human Trafficking and Internet Crimes Against Children Task Force.

What happened

Detectives accused Arrington of creating the child pornography material digitally, noting that there was no live victim involved in this specific case. The arrest was made possible under the Alabama Child Protection Act (ACPA), which was passed in 2024 to close legal loopholes that previously failed to account for 100% AI-generated imagery. The legislation, sponsored by State Rep. Matt Woods, was introduced after authorities identified instances where a child's face had been artificially superimposed onto the body of someone engaged in sexual activity.

While Arrington is considered innocent until proven guilty, the case has highlighted the ongoing efforts of the Alabama Joint Study Commission on Artificial Intelligence and Children's Internet Safety. The Commission, chaired by State Rep. Ben Robbins, is currently examining the role of AI platforms in facilitating such content and discussing where legal liability should fall as technology becomes more sophisticated. Following his arrest, Arrington posted a $100,000 bond and was released from the Madison County Jail. Lawmakers have emphasized that the legal consequences for creating, storing, or distributing AI-generated child pornography are intended to mirror those associated with traditional child exploitation material, warning offenders that they will be prosecuted to the fullest extent of the law.
