What happened
In January 2024, Jess Asato reported that she had been targeted by the generation of fake, sexualized images of herself created using the Grok AI tool. Asato described the experience as dehumanizing and likened the incident to a form of digital sexual assault. Despite xAI implementing subsequent changes to restrict the tool from generating sexualized images of real people, Asato argues that the company remains accountable for the initial lack of safety guardrails.
The legal claim is brought under the Data Protection Act and for tortious misuse of private information. Represented by the law firm AWO, Asato is seeking damages and aims to establish a legal precedent that companies must be held liable for the design choices of their AI systems. Her legal team argues that the harm resulted from specific engineering decisions made by xAI, asserting that safety should not be an afterthought in product development.
Asato has compared the situation to a manufacturing defect in a physical product, such as a car, arguing that fixing a flaw after the fact does not absolve the manufacturer of the harm caused by the initial design. Prime Minister Sir Keir Starmer has expressed support for the legal action, emphasizing the importance of holding platform providers accountable for the dissemination of abusive content. Asato continues to seek redress for the harms caused, noting that she has faced further instances of image manipulation since announcing her legal challenge.
