An Arizona appeals court has vacated the 10.5-year prison sentence of Gabriel Paul Horcasitas, ruling that a trial judge improperly relied on an AI-generated video of the victim during a sentencing hearing. While the court affirmed the underlying manslaughter conviction, it determined that the use of the synthetic media violated the defendant's right to due process.
What happened
During the sentencing hearing for the 2021 road rage death of Christopher Pelkey, the victim's sister introduced a video that combined real footage of the deceased with AI-generated content. The synthetic portion of the video featured a digital recreation of the victim's face and voice, delivering statements regarding his beliefs, family, and forgiveness toward his killer.
The sentencing judge explicitly praised the AI-generated video, describing it as "genuine" and stating that he "loved" the presentation. The judge cited the victim's supposed expressions of forgiveness within the video as a factor in his decision-making process, ultimately imposing a 10.5-year sentence, which exceeded the nine-year term requested by prosecutors.
On appeal, the Arizona Court of Appeals, Division One, ruled that while crime victims have a right to speak at sentencing, that right does not supersede a defendant's constitutional right to due process. The court held that information presented at sentencing must meet a minimum level of reliability, a standard the AI-generated video failed to satisfy because it portrayed the victim saying things he never actually said. The case has been remanded to the Maricopa County Superior Court for a new sentencing hearing.
