Elliston Berry (and other potential victims) deepfake (May 2025)

Elliston Berry was a survivor of deepfake image-based sexual abuse committed when she was 14. This incident, along with the broader issue of deepfake pornography, inspired the Take It Down Act, which criminalizes the distribution of sexually explicit material without consent, including AI-generated "deepfake pornography". The law also mandates social media platforms to remove such images within 48 hours of notification and introduces penalties including prison sentences and fines.
