In May 2024, the Delhi High Court granted interim personality rights protection to Aman Gupta, co-founder of boAt Lifestyle and judge on Shark Tank India. The court order restricts entities from using his identity without authorization across digital platforms, including AI-generated content.
What happened
The suit alleged widespread unauthorized use of Gupta’s name, image, likeness, voice, and persona through fake endorsements, AI-generated impersonations, unauthorized merchandise, misleading online listings, and deepfake content. The court order covered fake speaker booking websites, impersonation on Instagram, AI chatbot impersonation, publication of purported contact details, unauthorized merchandise, Telegram bots, and explicit deepfake content. The court noted sexually explicit material allegedly created using Gupta’s likeness required “immediate and urgent consideration.” The High Court restrained the defendants from using Gupta’s name, likeness, image, voice, videos, GIFs, photographs, or any aspect of his persona without written authorization, including AI-generated and deepfake content. The court directed intermediary platforms to remove infringing content and disclose details linked to certain accounts. A dynamic injunction allows Gupta to notify intermediary platforms about newly discovered infringing websites for prompt action.
